Welcome to Avioryx. The terms “we”, “us” and “our” refer to Avioryx. Avioryx is operated by Sonhai Tech Limited.

Avioryx operates this website and online store, including all related information, content, features, tools, products and services, in order to provide customers with a curated shopping experience collectively referred to as the “Services”.

Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced within them, describe your rights and responsibilities when accessing or using our Services.

Please read these Terms of Service carefully. They contain important information concerning orders, payments, shipping, returns, intellectual property, warranty disclaimers and limitations of liability.

By visiting, accessing, interacting with or purchasing through our Services, you agree to be bound by these Terms of Service and our Privacy Policy.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, province, territory or country of residence.

If you allow a minor dependent to access or use the Services through a device you own, purchase or manage, you are responsible for supervising their use.

To browse our store, create an account or purchase products, you may be required to provide certain information, including your name, email address, billing information, payment information, telephone number and shipping address.

You represent and warrant that all information you provide is accurate, current and complete, and that you have the necessary authorization to provide and use that information.

You are responsible for maintaining the confidentiality and security of your account credentials and for activities conducted through your account.

SECTION 2 – OUR PRODUCTS

We make reasonable efforts to ensure that product descriptions, specifications, dimensions, materials, photographs and other information displayed on our website are accurate.

However, the colors and appearance of a product may vary slightly from how they appear on your screen because of photography, lighting, device type, screen settings and production differences.

Some Avioryx products may contain resin components, hand-finished details, painted surfaces, small parts or individually produced components. Minor variations in color, surface texture, alignment, paint finish or detailing may occur between individual products and production batches.

These minor variations are not necessarily considered manufacturing defects when they do not materially affect the intended assembly, display, appearance or normal use of the product.

Product dimensions and measurements may have reasonable manufacturing tolerances.

Some products may require assembly. Customers should review the product description, included instructions and applicable safety information before beginning assembly.

Products containing small parts should be kept away from young children unless the product page specifically states that the item is suitable for their age group. Adult supervision may be required.

We reserve the right to modify product descriptions, specifications, prices, packaging or availability at any time without prior notice.

We may discontinue products or limit quantities available to any person, household, geographic region or jurisdiction on a case-by-case basis.

SECTION 3 – ORDERS

When you submit an order, you are making an offer to purchase the products listed in your order.

An automated order confirmation email acknowledges that we have received your order. It does not necessarily mean that your order has been finally accepted or shipped.

Your order is accepted once payment has been successfully processed and we begin fulfillment or otherwise confirm acceptance.

Avioryx reserves the right to refuse, limit or cancel an order when reasonably necessary, including in cases involving:

Suspected fraud or unauthorized payment activity
Incorrect pricing or product information
Product unavailability
Restrictions affecting delivery to the requested destination
Orders intended for unauthorized resale
Violations of these Terms of Service

If we cancel an order after payment has been received, the applicable amount will be refunded to the original payment method.

Please review your product selection, quantity, shipping address and contact details carefully before submitting your order.

We will make reasonable efforts to accommodate cancellation or address-change requests submitted before fulfillment begins. However, cancellation or modification cannot be guaranteed once an order has entered processing, packaging or shipment.

Once an order has shipped, it cannot normally be cancelled. An eligible product may be returned after delivery in accordance with our Refund & Return Policy.

Unless we give prior written permission, products purchased through Avioryx are intended for personal, household, gifting or collection purposes and not for unauthorized commercial resale.

SECTION 4 – PRICES, TAXES AND BILLING

Product prices, discounts and promotional offers may change without notice.

The price charged for a product will be the price displayed at the time the order is placed, subject to correction of genuine pricing errors.

The final amount payable will be displayed during checkout and confirmed in your order confirmation email.

Avioryx provides free standard worldwide shipping on eligible orders unless a different shipping method or charge is clearly disclosed before payment.

Avioryx also covers applicable import duties and standard customs clearance charges in accordance with our Shipping Policy.

In most cases, customers will not be required to pay additional import duties or standard customs clearance fees when their package is delivered.

If a local carrier or customs authority unexpectedly requests a customs-related payment, customers should contact us before making the payment so that we can review the charge and provide appropriate assistance.

Where applicable law requires tax, VAT, GST or another government charge to be collected directly at checkout, the applicable amount will be displayed before payment and included in the final order total.

Prices displayed in our online store may differ from prices available through third-party marketplaces, retailers, promotional campaigns or other sales channels.

Promotions may be subject to additional conditions. Where promotional terms conflict with these Terms of Service, the specific promotional terms will apply to that promotion.

You agree to provide current, complete and accurate billing, payment and account information for every purchase.

You represent and warrant that:

You are authorized to use the selected payment method
The payment provider will honor the applicable charges
You will pay the final amount displayed and approved during checkout

SECTION 5 – SHIPPING AND DELIVERY

Orders are processed and delivered in accordance with our Shipping Policy.

Processing and delivery times displayed on our website are estimates and are not guaranteed delivery dates.

Delivery may be affected by customs inspections, carrier delays, severe weather, local delivery disruptions, peak shopping periods, public holidays, address problems or other circumstances outside our reasonable control.

We are not responsible for reasonable delays caused solely by shipping carriers, customs authorities or events outside our control. However, we will provide reasonable assistance in investigating delayed, missing or lost shipments.

Tracking information may take up to 48 hours after shipment confirmation to display its first update.

Customers are responsible for providing an accurate and complete delivery address. If a package is delayed, returned, lost or delivered incorrectly because of an incomplete or incorrect address provided by the customer, additional reshipping or carrier costs may apply.

If a shipping-address error was caused by Avioryx, we will take responsibility and provide an appropriate replacement, reshipment or refund.

Risk of accidental loss or damage remains with Avioryx until the product is delivered to the address provided by the customer, except where applicable law provides otherwise.

SECTION 6 – RETURNS, REFUNDS AND REPLACEMENTS

Returns, refunds, replacements, missing-part claims and damaged-product claims are governed by our Refund & Return Policy.

Eligible unused and unassembled products may be returned within 30 days of delivery, subject to the conditions described in that policy.

Products that have been assembled, glued, painted, trimmed, modified, installed or damaged by the customer may not be eligible for a standard return.

If a product arrives damaged, defective, incomplete or different from the item ordered, the customer should contact us within 7 days of delivery and provide the requested photographs or video evidence.

Depending on the circumstances, an approved resolution may include replacement parts, a complete replacement, partial refund or full refund.

For non-defective returns resulting from a change of mind, incorrect selection or personal preference, the customer may be responsible for return shipping and other deductions described in our Refund & Return Policy.

Nothing in these Terms limits any mandatory return, refund, warranty or consumer-protection rights that cannot legally be excluded.

SECTION 7 – INTELLECTUAL PROPERTY

The Services, including our trademarks, brand names, logos, website design, product descriptions, text, graphics, photographs, videos, audio, illustrations, layouts and other original content, are owned by or licensed to Avioryx and are protected by applicable intellectual-property laws.

These Terms allow you to access and use the Services for personal and non-commercial purposes only.

Without our prior written permission, you may not:

Copy, reproduce, republish or distribute our website content
Modify or create derivative works from our content
Use our photographs, videos or product descriptions for commercial purposes
Use our trademarks, names, logos or branding
Scrape, download or systematically collect website content
Misrepresent yourself as being associated with or authorized by Avioryx

Nothing in these Terms grants you a license or ownership right in any intellectual property belonging to Avioryx, Shopify or another party.

Shopify’s names, logos, product names and trademarks remain the property of Shopify or its applicable licensors.

Aircraft names, airline names, manufacturers’ names, logos and other third-party marks appearing in descriptive product content remain the property of their respective owners. Unless expressly stated, their appearance does not imply sponsorship, endorsement or affiliation.

SECTION 8 – OPTIONAL AND THIRD-PARTY TOOLS

We may provide access to tools, applications or features operated by third parties.

We do not necessarily monitor, control or endorse these third-party tools.

Unless otherwise stated, access to such tools is provided on an “as available” basis. Your use of third-party tools is subject to the provider’s own terms, privacy practices and conditions.

You should review and understand the relevant third-party terms before using those tools.

We may introduce new website features, applications, services or resources in the future. Such features will form part of the Services and will be subject to these Terms.

The Services may contain links to third-party websites, applications, payment providers, tracking services or other external resources.

SECTION 10 – RELATIONSHIP WITH SHOPIFY

Avioryx is powered by Shopify, which provides the ecommerce infrastructure that enables us to offer the Services.

However, purchases made through our store are transactions directly between you and Avioryx.

Shopify is not the seller of Avioryx products and is not responsible for product fulfillment, shipping, customer service, returns, refunds or claims relating to products purchased from Avioryx.

To the extent permitted by law, you release Shopify and its affiliates from claims arising solely from the sales transaction between you and Avioryx.

SECTION 11 – PRIVACY POLICY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because the Services are hosted by Shopify, Shopify may collect and process information concerning your access to and use of the Services in order to operate, secure and improve the platform.

Information submitted through the Services may be processed by Shopify, payment providers, shipping providers, analytics providers and other service providers that assist us in fulfilling orders and operating our business.

Your Feedback is accurate to the best of your knowledge
You have disclosed any compensation or incentive connected with the Feedback
Your Feedback does not violate another person’s intellectual-property, privacy or other legal rights
Your Feedback does not contain unlawful, defamatory, abusive, obscene or malicious material

We are not required to keep Feedback confidential, compensate you for Feedback or respond to every submission.

If an order is cancelled because of a material error after payment has been received, we will refund the applicable amount to the original payment method.

To the fullest extent permitted by applicable law, Avioryx, Sonhai Tech Limited, our affiliates, directors, officers, employees, agents, contractors, service providers and licensors will not be liable for indirect, incidental, special, punitive or consequential losses arising from your use of the Services or purchase of a product.

This may include loss of profits, revenue, savings, data or business opportunity, except where such liability cannot legally be excluded.

Our total liability for a claim relating to a specific order will not exceed the amount paid for the product giving rise to that claim, unless applicable law requires otherwise.

These limitations do not apply to liability resulting from fraud, willful misconduct, death or personal injury caused by negligence, or any other liability that cannot legally be limited.

SECTION 18 – INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Avioryx, Sonhai Tech Limited, Shopify and our respective affiliates, directors, officers, employees, agents, contractors, licensors and service providers from third-party claims, losses, liabilities and reasonable legal expenses arising from:

Your unlawful use of the Services
Your infringement of another party’s rights
Content or Feedback you submit through the Services

This obligation does not apply to the extent that a claim was caused by our own unlawful conduct, negligence or breach of these Terms.

The unenforceable portion will be treated as severed, and the remaining provisions will continue in full force and effect.

These Terms of Service and any separate agreement through which we provide the Services will be governed by the laws of Hong Kong Special Administrative Region, without regard to conflict-of-law principles.

Any dispute that cannot be resolved informally will be subject to the jurisdiction of the courts of Hong Kong, unless mandatory consumer-protection law gives you the right to bring a claim in another jurisdiction.

Nothing in this section limits any mandatory rights available to consumers under the laws of their country or region of residence.
